These Terms of Service ("Terms") govern your use of the TackRoom mobile app and related services. By creating an account or using TackRoom, you agree to these Terms. If you do not agree, do not use TackRoom.
1. Eligibility
You must be at least 18 years old, or have the permission of a parent or legal guardian, to use TackRoom. By using TackRoom you represent that you meet this requirement.
2. The service
TackRoom is a peer-to-peer marketplace for buying and selling horse tack in New Zealand. TackRoom is not a party to transactions between users. TackRoom is not responsible for the quality, safety, legality, or accuracy of listings.
3. Your account
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate information and keep it updated.
4. Listings and content
When you post a listing or message, you grant TackRoom a non-exclusive, worldwide, royalty-free licence to host, display, and distribute that content within the app for the purpose of operating the service.
5. Prohibited content and conduct — zero tolerance
- Counterfeit, stolen, or illegal goods.
- Items prohibited by New Zealand law, including firearms, controlled drugs, or live animals.
- Content that is sexually explicit, violent, hateful, harassing, defamatory, or discriminatory.
- Fraud, scams, or misrepresentation of goods.
- Spam, phishing, or unsolicited commercial messages.
- Impersonation of another person or entity.
- Infringement of intellectual property or privacy rights of others.
- Attempts to circumvent the app's fees or payment system.
- Automated scraping, bulk downloading, or reverse engineering.
Violation may result in content removal, account suspension, or permanent ban at our sole discretion. We review reports within 24 hours and act on confirmed violations.
6. Reporting and blocking
Users can report any listing, user, or message by tapping the flag icon in the app. Users can block other users from their profile. TackRoom reviews every report within 24 hours and removes violating content.
7. Fees and payments
Listing is free. When an item sells through TackRoom, a commission of 5.99% (minimum NZD $1.50, capped at NZD $100) is deducted from the sale price. Payments are processed by Stripe. Disputes are handled per Stripe's policies and our support channel.
8. Refunds
Because items are sold directly between users, refunds are at the seller's discretion unless required by New Zealand consumer law. If an item is not as described, buyers should first contact the seller. If unresolved, contact support@tackroom.co.nz.
9. Termination
You may delete your account at any time by contacting support. We may suspend or terminate your account if you violate these Terms or if required by law.
10. Disclaimer
TackRoom is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties. We are not liable for indirect, consequential, or incidental damages.
11. Changes to these terms
We may update these Terms. If changes are material, we will require you to re-accept before continuing to use the app.
